Rockatar Inc. is committed to protect the privacy and security of its online visitors. We take your privacy and that of your child very seriously. Our website has three types of visitors, namely non-members, free members and paid members. No personal information is collected from our visitors in the general areas of our web site; therefore non-members will have no personal information stored on our server about our visitors.

Free Members:

If a user is registering as a free member on our site, some basic information must be submitted for the registration process. Below is how the information is gathered:

If a free member/user is below 13, he or she will be required to enter the following:

·         Date of birth

·         Username (fictitious name, i.e., a nickname or handle, for anonymous website participation).

·         Password

·         Parent’s or guardian’s email address.

We do not collect any personally identifiable information from persons under the age of 13. All membership data is secured in an area not accessible to the public. 

In the event that we intend to take personally identifiable information from children under the age of 13 at any time in the future, we will first make every reasonable attempt to notify the parent or guardian at the email address and other addresses provided in the registration process or by later submission. Notification in that instance will be in accordance with federal law, and will include:

(1) the exact nature and intended use of the information we’re collecting;

(2) whether we’re collecting it actively or passively;

(3) whether such information is disclosed to third parties;

(4) if there is disclosure to third parties, various types of information about those third parties as required by federal regulation;

(5) giving the parent the right to deny consent to this disclosure;

(6) informing the parents or guardians that we cannot condition a child’s participation in an activity on the disclosure of more information than what is reasonably necessary to participate; and,

(7) that the parent or legal guardian can review the child’s personal information and refuse to permit the further collection or use of the child’s information. See, United States Code of Federal Regulations, at 16 C.F.R. §312.4(b) (2).

Before collecting, using or disclosing personal information from a child (anyone under 13 years of age), we shall obtain verifiable parental consent from the child’s parent, such as an email or mail-in letter. We will make reasonable efforts, taking into account available technology, to ensure that before personal information is collected from a child, a parent or legal guardian of the child receives notice of the information and our intended practices and consents to those practices. Paid Members:

If a user is registering as a paid member on our site all participants are requested to submit basic information for the registration process.

We do not collect any personal information from paid members, except for the e-mail address. If an e-mail address or any other personal information is given for feedback or mailing, we do not share any personal information with any third parties nor do we use any personal information for any purposes other than to respond to the user inquiries.

If a user is registering as a Paid member on our site, members over 13 years of age and parents or guardians of children 13 and under, will be requested to submit basic information for the registration process. (This information will include a valid e-mail address, suggested username and a password ONLY) During the registration process we will use a PCI DSS (Payment Card Industry Data Security Standard) compliant 3rd party credit card processing company to verify the parent’s identification.

These are the Guidelines for members:

1. We will NOT deliberately collect, use, or distribute personally identifiable information from children under the age of 13 without prior verifiable consent from a parent or guardian.

2. Personally identifiable information we collect from children under the age of 13 will be used solely by Rockatar INC is for internal purposes only and will NOT be sold or otherwise distributed to third parties. An exception exists for the unlikely event where we are ordered to turn over personal information by a federal court order.

3. We will NOT knowingly allow children under the age of 13 to access message boards, forums, email accounts, or other services within Rockatar website that would allow them to publicly post or otherwise distribute personally identifiable information without prior verifiable consent from a parent or guardian.

4.  We will NOT knowingly post or allow to post any personally identifiable information that is inadvertently included in a child's submission to a general audience contribution area if we know that the child is under the age of 13. These submissions will be deleted and handled anonymously thereafter.

We will NOT knowingly make available any direct link to websites that are unsuitable for children or teens.

5.  We will advise children under the age of 13 that they MUST obtain permission from their parent or guardian before sharing ANY personal information.

6.  We will monitor the actions and behavior of users and we will take action to stop any improper activities or inappropriate or offensive language, including also threatening, harassing or bullying behavior or language or web-talk obscene gestures. In such cases we will make every reasonable effort to advise parents regarding their child’s behavior.

7.  We will carefully monitor (view and listen) every song video, animation posting, audio track, image file and text comment posted by users which will appear on the public areas and non-public areas of our site.  If we identify any postings considered to be unsuitable for children, we will preclude them from appearance in the public areas. In such cases, we will make reasonable efforts to inform the parents of the children involved regarding the incidents. We will delete the material as soon as reasonably possible.

8.   We will monitor and filter every word posted by users on our site electronically and manually.

9.  Upon request, Rockatar will provide a parent or legal guardian with a transcript or record of any information provided by or about their child during a registration process for a program or service of this site.

10.  We will provide notice to children in age appropriate terminology regarding what personally identifiable information is to be collected, if any.

11. We don’t share personal identifying information with third parties, but if the unlikely occurrence of sharing with third parties arises in the future, we shall always give a parent the option of agreeing to the collection and use of the child’s personal information without agreeing to the disclosure of the information to any such third parties.     

12.  As much as we reasonably can, we’ll review the practices and interactions of the users in all other important respects to try and make sure that the content and activities conducted on the site are suitable for children, family-safe and generally supportive of your child’s entertainment and educational needs.

 13.  As permitted by law, we may at times release personal information to others who use it solely to provide support for the internal operations of our site, including for technical support and order fulfillment.

Advertisers:

We use third-party advertising companies to serve ads when you visit our Web site.
